Welcome to EYVA.
These Terms of Service (“Terms”) govern your access to and use of the EYVA wellness device, the EYVA mobile application, the Anthea Realm companion application where applicable, the EYVA website at www.eyva.io, and all related products, software, applications, services, content, and features (collectively, the “Services”).
The Services are provided by BlueSemi Research & Development Private Limited (“BlueSemi,” “EYVA,” “we,” “us,” or “our”), a company incorporated under the laws of India.
By purchasing, accessing, downloading, registering for, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Warranty Policy, and applicable Return & Refund Policy.
If you do not agree to these Terms, please do not purchase or use the Services.
EYVA is a technology-enabled wellness platform designed to help users understand certain aspects of their wellness through non-invasive sensing, data analysis, historical trends, and personalized insights.
The EYVA ecosystem may include:
The EYVA wellness device (“Device”)
The EYVA mobile application (“App”)
The Anthea Realm companion application, where applicable
Device firmware and software
Cloud-based services
Wellness scores, trends, insights, and reports
Customer support and related services
The EYVA website and other digital platforms
The features and functionality available to you may vary depending on your Device, App version, subscription or service plan, location, and other factors.
For purposes of these Terms:
“Device” means the EYVA hardware device, including its embedded firmware, sensors, electronics, accessories, and related components.
“App” means the EYVA mobile application and any companion application made available by EYVA for use with the Device.
“Services” means the Device, App, website, software, firmware, cloud services, wellness features, content, support, and other services provided by EYVA.
“Wellness Data” means information, measurements, readings, trends, scores, and other data generated or collected through your use of the Device and Services.
“Content” means text, graphics, images, software, interfaces, reports, designs, information, documentation, and other materials made available through the Services.
“User Account” means an account or profile created by you to access certain EYVA Services.
You must be at least 18 years old to independently purchase and use the Services.
If you are between 13 and 18 years of age, you may use the Services only with the supervision and consent of a parent or legal guardian who agrees to these Terms on your behalf.
The Services are not intended for children under 13 years of age.
By using the Services, you represent that you meet the applicable age requirements and have the legal capacity to enter into these Terms.
Certain EYVA Services may require you to create a User Account.
You agree to:
Provide accurate, complete, and current information
Keep your account information updated
Maintain the confidentiality of your login credentials
Take reasonable steps to protect your account
Notify EYVA promptly of any unauthorized access or suspected security breach
Use the Services only through your authorized account or profile
You are responsible for activity conducted through your account to the extent permitted by applicable law.
The Device may support multiple user profiles depending on the Device model and software version. Each user should use their own profile to help ensure that Wellness Data is correctly associated with the appropriate individual.
You must not knowingly create false profiles or provide inaccurate information that could result in another person's data being incorrectly associated with your profile.
Subject to your compliance with these Terms, EYVA grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Services for your personal, non-commercial wellness purposes.
You may not:
Copy, reproduce, modify, or distribute the Services except as expressly permitted
Reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or underlying technology
Modify or create derivative works based on the Device, App, firmware, or Services
Circumvent or disable security features
Remove proprietary notices, labels, trademarks, or copyright notices
Use the Services for unlawful, fraudulent, or unauthorized purposes
Resell, lease, sublicense, or commercially exploit the Services without written authorization from EYVA
Attempt to gain unauthorized access to EYVA systems, servers, accounts, or data
Interfere with or disrupt the operation of the Services
Use the Services in a way that violates applicable laws or regulations
EYVA reserves all rights not expressly granted under these Terms.
The EYVA Device is precision electronic equipment and should be used in accordance with the official EYVA User Guide and instructions.
You agree to:
Use the Device only as instructed
Handle the Device with reasonable care
Keep the Device clean and dry
Protect the Device from excessive heat, moisture, direct sunlight, corrosive substances, and other environmental conditions that may damage it
Use only approved accessories where applicable
Follow the recommended procedure when taking a reading
Keep the Device and its software reasonably up to date
Do not attempt to open, modify, repair, or alter the Device unless expressly authorized by EYVA.
Unauthorized modification may affect Device performance and may void applicable warranty coverage.
EYVA is a general wellness product and is not intended to diagnose, treat, cure, prevent, or monitor any disease or medical condition unless expressly stated otherwise for a specific product or service.
Wellness scores, measurements, trends, indicators, insights, recommendations, and other information provided through the Services are intended for general wellness and informational purposes.
They should not be considered medical advice and should not be used as a substitute for consultation with a qualified healthcare professional.
EYVA does not represent that the Services are appropriate for every individual or medical circumstance.
You should not use EYVA information as the sole basis for making decisions concerning:
Diagnosis of a medical condition
Medication
Treatment
Changes to prescribed healthcare
Emergency medical care
Other medical decisions
If you have concerns about your health or symptoms, consult an appropriately qualified healthcare professional.
If you believe you are experiencing a medical emergency, contact your local emergency medical services immediately.
The Services use sensors, algorithms, software, statistical models, and other technologies to generate wellness information.
Measurements and insights may be affected by factors including, but not limited to:
Device positioning
User movement
Environmental conditions
Sensor contact
Individual physiological characteristics
Device condition
Software or firmware versions
Data availability
Algorithmic limitations
EYVA does not guarantee that every measurement, trend, score, or insight will be accurate, complete, continuous, or suitable for a particular purpose.
The Services are intended to help users understand wellness patterns and trends and should be interpreted accordingly.
Your privacy is important to us.
EYVA may collect and process personal information and Wellness Data in connection with providing the Services.
Our collection, use, storage, disclosure, retention, and protection of personal information are described in our Privacy Policy.
Where applicable, EYVA processes personal data in accordance with the Digital Personal Data Protection Act, 2023 and other applicable Indian data protection laws.
Subject to applicable law and the Privacy Policy:
You retain your rights in your personal information and Wellness Data
EYVA does not sell your personal Wellness Data
Data may be processed to provide and improve the Services
Data may be processed by service providers acting on EYVA's behalf
Aggregated or anonymized information may be used for research, analytics, product improvement, algorithm development, and other legitimate purposes
You may have rights to access, correct, or delete certain personal data

All intellectual property rights relating to the Services are owned by or licensed to BlueSemi Research & Development Private Limited.
This includes, without limitation:
EYVA trademarks and logos
Device designs
Hardware and firmware
Software and applications
Algorithms and models
Interfaces
Reports and visualizations
Website content
Documentation
Graphics, text, images, and other Content
Nothing in these Terms transfers ownership of any intellectual property to you.
The EYVA name, logos, marks, product names, and related branding may not be copied, reproduced, modified, or used without prior written permission from EYVA, except as permitted by applicable law.
If you provide EYVA with feedback, suggestions, ideas, reviews, or recommendations regarding the Services (“Feedback”), you grant EYVA a non-exclusive, worldwide, royalty-free right to use, reproduce, modify, adapt, publish, and otherwise use that Feedback for business, research, product development, and improvement purposes.
You agree that EYVA may use Feedback without compensation or attribution unless otherwise agreed in writing.
The Services may interact with or contain links to third-party services, platforms, applications, payment processors, app stores, hosting providers, or other third-party technologies.
Third-party services may be governed by their own terms and privacy policies.
EYVA is not responsible for the availability, functionality, security, or content of third-party services to the extent permitted by applicable law.
Your use of third-party services is subject to the applicable third-party terms.
The App may be made available through third-party application stores, including Apple App Store and Google Play.
Your use of the App may also be subject to the applicable terms and policies of the relevant app store.
EYVA may periodically release updates to the App, firmware, software, algorithms, or other components of the Services.
Updates may include:
Bug fixes
Security improvements
Performance improvements
New functionality
Changes to existing functionality
Compatibility improvements
Certain updates may be required for continued access to or functionality of the Services.
Purchases of EYVA products are subject to the applicable product pricing, availability, shipping terms, and payment conditions presented at the time of purchase.
You agree to provide accurate billing, shipping, and contact information.
Additional terms relating to delivery, cancellation, returns, exchanges, and refunds are provided in EYVA's applicable policies.
Our Return & Refund Policy governs eligible returns and refunds.
Our Shipping Policy governs applicable delivery and shipping conditions.
Nothing in these Terms limits any mandatory consumer rights available under applicable law.
EYVA Devices are covered by the applicable limited manufacturer's warranty described in the EYVA Warranty Policy.
Unless otherwise specified in the applicable warranty documentation, the Device is covered for one (1) year from the date of original purchase against defects in materials and workmanship under normal use.
The warranty does not generally cover damage resulting from circumstances including:
Misuse
Accidental damage
Neglect
Unauthorized modification
Improper installation or use
Use contrary to the User Guide
Use with unauthorized accessories where applicable
Normal wear and tear
Damage caused by external conditions

EYVA will make reasonable efforts to maintain the Services, but we do not guarantee that the Services will always be:
Available
Uninterrupted
Secure
Error-free
Free from technical issues
Compatible with every device or operating system
The Services may occasionally be unavailable due to maintenance, upgrades, technical problems, network failures, third-party services, security incidents, or circumstances beyond our reasonable control.
You may stop using the Services at any time.
EYVA may suspend or terminate access to certain Services where reasonably necessary, including if:
You materially breach these Terms
You misuse the Services
You engage in fraudulent or unlawful activity
Your use creates a security or operational risk
Suspension is necessary to comply with applicable law
The relevant Service is discontinued
Where reasonably practicable, EYVA may provide notice before suspension or termination.
Upon termination, your license to use applicable software and cloud-based Services will cease.
Certain provisions of these Terms will survive termination, including provisions relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and other provisions that by their nature should survive.
To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Except for warranties expressly provided by EYVA in writing, EYVA disclaims warranties, representations, and conditions, express or implied, including warranties of:
Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy
Availability
Reliability
Uninterrupted operation
Nothing in these Terms excludes or limits any warranty, right, or protection that cannot legally be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, BlueSemi Research & Development Private Limited and its directors, officers, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Services.
This includes, to the extent permitted by law, loss of data, loss of profits, loss of business, loss of goodwill, or other consequential losses.
To the maximum extent permitted by applicable law, EYVA's aggregate liability arising from or relating to the Services will be limited to the amount paid by you to EYVA for the specific product or service giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless BlueSemi Research & Development Private Limited, its affiliates, directors, officers, employees, agents, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising out of or relating to:
Your violation of these Terms
Your misuse of the Services
Your violation of applicable laws or regulations
Your infringement of the rights of another person or entity
Unauthorized use of your account
Your violation of any third-party rights
EYVA reserves the right to assume exclusive control of the defense of any matter subject to indemnification, in which case you agree to cooperate with EYVA as reasonably requested.
These Terms shall be governed by and interpreted in accordance with the laws of India.
Subject to applicable consumer protection laws and other mandatory legal rights, disputes arising out of or relating to these Terms or the Services shall be subject to the jurisdiction of the competent courts in Hyderabad, Telangana, India.
Nothing in this section limits any mandatory rights or remedies available to consumers under applicable law.
EYVA may update these Terms from time to time to reflect changes in our Services, technology, business practices, or applicable laws.
When material changes are made, we may provide notice through the EYVA website, App, email, or other appropriate means.
The updated Terms will include a revised “Last Updated” date.
Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
If you do not agree with the revised Terms, you should discontinue use of the affected Services.
These Terms, together with the EYVA Privacy Policy, Warranty Policy, Return & Refund Policy, Shipping Policy, and any other applicable terms expressly incorporated by reference, constitute the agreement between you and EYVA regarding the Services.
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
A failure or delay by EYVA to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
You may not assign or transfer your rights or obligations under these Terms without EYVA's prior written consent.
EYVA may assign or transfer its rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other business transaction.
EYVA will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, pandemics, governmental actions, internet or telecommunications failures, infrastructure failures, power outages, labor disputes, or other force majeure events.
